DESCRIPTION : “Exploring Forest Department’s Occupation of Private Land in Madhya Pradesh” is not just a book, but a document of the experiences, struggles and quest for justice of thousands of landowners whose private land has been disputed due to forest department control, claims or archival errors due to various reasons.
In this book, we have tried to understand through actual cases, court decisions, government orders, departmental instructions, questions asked in the assembly, records of the revenue and forest department and other available documents that the forest department’s claim on private land in Madhya Pradesh was established, what legal grounds were given for it and what difficulties the land owners faced in such cases.
The purpose of the book is not to criticize any department or institution, but to compile factual information at one place and provide a reference material for citizens, researchers, lawyers, public representatives and administrative officers. Many government orders, guidelines and policy decisions related to this subject are scattered in various records. Efforts have been made to collect them and present them in simple language so that the common citizen can also understand his rights and the legal remedies available.
A major cause of land disputes in Madhya Pradesh has been inconsistencies in revenue and forest records, demarcation problems and complexities of historical records. In many cases, orders and instructions have been issued by the Government from time to time for redressal of disputes and to provide relief to eligible land owners. Such important documents have also been included in this book.
We are confident that this book will help in understanding the complex questions related to private land and forest land and will work to increase awareness regarding land rights. If this effort helps an affected person to protect his rights or to get justice, then our labour will be worthwhile.
